1. OVERVIEW 

This website is operated by Doll Fashion (Pty) Ltd. Throughout these terms “we”, “us” and “our” refer to Doll Fashion. We offer this website, including all information, tools and services available from this website to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated herein.

 By visiting our website and/or purchasing goods from us, you engage in our “service” and agree to be bound by these terms and conditions. You may not use our products for any illegal or unauthorised purpose nor may you, in the use of the service, violate any laws in your jurisdiction (including but not limited to copyright laws). Any offer for any product or service made on this site is void where prohibited.

 

2. ORDERS

2.1 Purchase of Products

When a product is ordered from our website, this is an offer to buy the product at the price stated, subject to these terms. We will take all reasonable care to ensure that all details, descriptions, images and prices of products appearing on our website are correct.

We reserve the right to refuse an order. Non-acceptance of an order may, for example, result from one of the following:

• The product ordered is no longer available
• Our inability to obtain authorisation of payment
• The identification of an error within the product information, for example price or promotion details

2.2 Order Acceptance and Cancellation

Your receipt of an electronic, or other, order confirmation does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. We reserve the right at any time after receipt of your order to accept, decline, or limit your order for any reason, whether your payment has been authorised or not. If your payment has been authorised and your order is cancelled, you will receive a refund.

We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors. You agree to provide current, complete and accurate purchase and account information for all purchases made at our store.

Once an order has been placed it cannot be cancelled by you.

  

Prices are displayed on our website in Euro. The currency converter can be used to display the prices in other currencies, but the sale will be conducted in Euro.

Prices are subject to change at any time. 

 

4. SHIPPING AND DELIVERY

All goods are shipped from South Africa using DHL Express or another courier service of our choosing. Tracking information is sent via email on the day that the order is shipped. A physical/street address is required as deliveries cannot be made to a Postal Box. Detailed and accurate address and contact information must be supplied by you.

Should a shipment be returned to us due to incorrect delivery information, and then shipped again, you will be liable for any additional shipping charges incurred in returning and/or re-shipping the goods. Should a shipment be returned to us due to incorrect delivery information and you request a refund or credit, the original and return shipping costs will be deducted from the refund or credit amount.

All risk in and to the goods transfers to you as soon as they leave our premises. Doll Fashion is not responsible for lost or stolen packages, or packages delayed in transit.

Orders are processed once payment has been made in full and goods are usually shipped within 48 hours of orders being accepted by us (excluding weekends and public holidays). International orders are usually received by our customers within 5 to 7 days after being shipped, however customs processing or COVID related issues may cause delays beyond our control.

 

5. PAYMENT

Payment may be made via the payment gateway/s on our website.

 5.1 Local Taxes and Customs Duties

You will be responsible for all customs duties and taxes of any kind in the country of destination, for example VAT, GST or import duties and for all quotas, permits, product restrictions and any other local requirements. All such charges must be paid by the recipient of the parcel. Customs policies vary widely from state to state and country to country, and we therefore recommend that you check the requirements in your country and/or state before placing an order. Non-delivery by our courier company due to the receiver refusing to pay any charges levied does not constitute a return of the goods and does not qualify for a refund.

 5.2 Trade Agreements Resulting in Reduced or No Duties

Doll Fashion is registered in respect of the trade agreements listed below. Our goods should therefore attract no or reduced duties on entry into the relevant countries. If you believe your country is covered by one of these trade agreements and you are charged duties when the goods arrive, please question this with the courier company (before paying) and quote Doll Fashion’s customs code –  21829002.

6. RETURN AND REFUNDS POLICY

It is our desire that you are entirely happy with your purchases from Doll Fashion. If you receive a product that you are unhappy with and wish to return it, please follow the process and instructions below –

• Contact us by email at online@dollfashion.net within 7 days of receiving your order advising us of your decision to return and include
• your order number;
• whether you prefer a credit or a refund (a credit will be issued if a refund is not specifically requested).
• An email will be sent to you advising of the return address and process. Note that return courier costs are your responsibility and a tracked courier service (such as DHL, or equivalent) is advised as the goods remain your responsibility and risk until received by us.
• The goods must be returned in their original condition: unworn, unwashed, unaltered, with all original markings and tags attached and in original signature packaging, if any.
• The goods must be received back by us within 30 days of your receiving your order.
• We will evaluate the condition of the returned goods upon receipt and, if deemed suitable by us for return, will endeavour to issue a credit or refund (via your original payment method) within 48 hours thereof.
• The original shipping cost (or a portion thereof depending on the quantity and weight of goods returned) will be deducted from the amount credited or refunded to you as this amount was included in the original purchase price.
• If the goods are deemed unsuitable for return, you will be advised and will have the option of having them shipped back to you at your cost. 

Sale goods may not be returned.

Doll Fashion does not offer an exchange policy. You may effect an exchange by processing a return (as detailed above) and placing a new order.

If you have received a damaged product or have a product complaint, please email us at online@dollfashion.net with a photo of the defective product and your order number.

 

7. DISCLAIMERS

While we make every attempt to be as accurate as possible with product descriptions, images, and prices, we do not warrant that any such information is accurate.

We are constantly updating and revising our offerings of products, and we may discontinue products at any time without notice. We reserve the right to make adjustments to our products and prices due to changing market conditions, currency fluctuations, product discontinuation, errors in advertisements, and other extenuating circumstances.

Doll Fashion assumes no responsibility and makes no guarantee regarding the fabric colours or prints of garments displayed on our website. Fabric colours represented on digital screens may vary due to variations in resolution, colour, tone, or any other display settings.

We may provide you with access to third-party tools over which we neither monitor nor have any control nor input. You acknowledge and agree that we provide access to such tools ‘as is’ and ‘as available’ without any warranties, representations or conditions of any kind and without any endorsement. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools. Any use by you of optional tools offered through our website is entirely at your own risk and discretion and you should ensure that you are familiar with and approve of the terms on which tools are provided by the relevant third-party providers. We may also, in the future, offer new services and/or features through our website (including, the release of new tools and resources). Such new features and/or services shall also be subject to these terms and conditions.

 In no case shall Doll Fashion, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any goods procured using the service, or for any other claim related in any way to your use of the service or any goods, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law. You agree to indemnify, defend and hold harmless Doll Fashion and our affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these terms and conditions, or your violation of any law or the rights of a third-party

 

8. CUSTOMER PRIVACY POLICY

Doll Fashion will take all reasonable steps to protect the personal information of users of our website. For the purposes of this clause “personal information” shall be defined as detailed in the Protection of Personal Information Act, Act 4 of 2013 of South Africa (POPIA).
